Biotec Pharmacon has been informed by the U.S. District Court, District of Minnesota that the case regarding the remaining outstanding patent issues with Biothera has been scheduled for 14 September, 2009.
Biothera had originally made claims under 14 U.S. patents, but all claims under 12 of these patents were eliminated from further litigation in a U.S. District Court Order in January 2009. The court case will thus only try Biothera’s claims under two patents and two claims related to remarks attributed in the Norwegian press to former executives of Biotec Pharmacon.
Biotec Pharmacon welcomes the opportunity to present its evidence to the U.S. District Court on these remaining issues.
